Background

On July 24, 2009 the Court issued a Temporary Restraining Order With Asset Freeze, Appointment of Receiver and Other Equitable Relief (Copy of TRO is available under Court Filings) in response to a Complaint (copy of Complaint is available under Court Filings), Application for a Temporary Restraining Order, and Memorandum of Points and Authorities filed by the FTC, Kansas Attorney General, Minnesota Attorney General, and North Carolina Attorney General against the defendants, Affiliate Strategies Inc (ASI), et al

After reviewing the evidence submitted by the FTC and States, U.S. District Judge Julie Robinson found that good cause exists to believe that defendants have engage in and are likely to engage in acts and practices that violate Section 5(a) of the Federal Trade Commission Act, the Kansas Consumer Protection Act, the Minnesota Uniform Deceptive Trade Practices Act, the Minnesota Prevention of Consumer Fraud Act, and the North Carolina Unfair and Deceptive Trade Practices Act.

A hearing has been scheduled before the Honorable Julie Robinson at 1:30pm, August 12, 2009 to hear evidence why the Court should not enter a Preliminary Injunction pending final ruling on the Complaint against the Defendants, enjoining them from further violations, continuing the freeze of their assets, continuing the Receivership, and imposing additional relief as may be appropriate.

Receivership Information

The order appointing Temporary Receiver authorizes the Receiver to, "Take exclusive custody, control, and possession of all assets and documents of, or in the possession, custody, or under the control of, the Receivership Defendants, wherever situated." The Receiver operates under the authority of the Court and reports directly to the Court.

This web site is created to provide all information currently available to the consumers on the status of the Receivership. All new court filings relevant to the Receivership will be posted to this site and available for review and download.

In the event that sufficient funds are recovered to pay consumer claims and refunds, a notice will be posted on this web site, including the forms and instructions to file your claim.
